FEDERAL

CMA, AMA and Others Developing Alternative Medicare Payment System to Replace SGR.  The California Medical Association (CMA) and the American Medical Association (AMA), along with more than 100 state and specialty medical societies, sent a letter to Congress on October 15, 2012, outlining the principles and core elements needed to successfully transition from the critically flawed Sustainable Growth Rate (SGR) to a higher performing Medicare program.  Click here for more information on the alternative payment plan to replace the SGR.

Recovery Audit Contractor Overpayments: Pulmonary Diagnostic Testing and E/M Services.  The California Medical Association (CMA) has recently learned that RAC contractor, Health Data Institute (HDI), is currently assessing overpayments for evaluation and management services billed without a modifier -25 on the same day as a diagnostic pulmonary study.  Affected claims have dates of service of 2009 or 2010.  Click here for more information and guidelines for appeal.

STATE

CMA Delegates Set Policy at Annual Meeting.  More than 500 California physicians convened in Sacramento on October 13-15, 2012, for the House of Delegates (HOD), the annual meeting of the California Medical Association (CMA).  Each year, physicians from all 53 California counties, representing all modes of practice, meet to discuss issues related to health care policy, medicine and patient care and to elect CMA officers.  Click here for a copy of the HOD’s final actions.

CMA Legislative Wrap-up.  Click here to read CMA’s 2012 Legislative Wrap-up.  Following are a few highlights:

  • Despite bipartisan support for CMA’s efforts, the Healthy Families program became collateral damage to partisan politics.  We’re working with stakeholders on the transition of kids to Medi-Cal.
  • The Governor signed into law AB 2109, requiring a parent or guardian seeking a personal belief exemption for their child to obtain a document signed by themselves and a licensed healthcare practitioner.
  • CMA joined a large coalition of healthcare providers in an attempt to create a physician health program in California.  Despite an end to this bill, we are confident that the conversation can continue, and this will be an issue CMA will look to advance next year.
  • CMA killed AB 1062, which would have encouraged use of the elder abuse law to get around the MICRA cap and plaintiff attorney fee limits.
  • CMA killed SB 924, which would have provided a framework where physical therapists might treat a patient directly without first seeing a physician.
  • CMA killed SB 1373, which would have required that a healthcare provider inform an enrollee in writing, prior to providing out-of-network services — and more!
  • CMA killed SB 1528, a back-door attack on MICRA, which would have allowed an injured party of medical services to be compensated based upon the reasonable value of services rather than the amount actually paid, thereby dramatically increasing economic damage awards in all personal injury cases.

Sacramento County’s Low Income Health Program (LIHP) Begins Enrollment.  The LIHP program allows Sacramento County residents who do not quality for Medi-Cal to receive health care coverage until, due to the Affordable Care Act, the Medicaid program expands to all non-Medicare eligible individuals in 2014.  Sacramento County has contracted with Molina Healthcare to manage the LIHP program.  Enrollment begins November 1.  Click here for more information.

Sacramento County Meningitis Recall Health Alert.  The CDC and FDA are investigating a multistate outbreak of fungal meningitis associated with epidural injection of preservative-free methylprednisolone acetate (80mg/ml) manufactured by the New England Compounding Center (NECC).  Sacramento County Health and Human Services is requesting all reported cases of meningitis be faxed to Disease Control and Epidemiology at (916) 875-4069 (confidential facsimile).  Click here for a copy of the October 11 Meningitis Recall Health Alert, issued by Olivia Kasirye, MD, Sacramento County Public Health Officer.  For more information, contact Sacramento County Disease Control and Epidemiology at (916) 875-5881.

West Nile Virus.  West Nile Virus (WNV) has claimed the life of a 74-year-old Auburn, California man.  He is the fifth person in the state to die from WNV this year.  In 2011, there were 158 reported WNV cases in California which claimed the lives of 9 people. The Centers for Disease Control and Prevention has extensive information and guidance for clinicians about WNV. For California specific up-to-date information on the current outbreak, click here

Hantavirus.  Late this summer, an outbreak of Hantavirus Pulmonary Syndrome (HPS) was reported at Yosemite National Park.  So far, three park visitors who contracted the virus have died, and the CDC estimates that 10,000 people may have been exposed.  Click here for more information on symptoms of HPS.

SAVE THE DATE -- Thursday, January 17, 2013!  SSVMS & Alliance Annual Installation and Awards Dinner, Hyatt Regency Hotel, Sacramento, 6:00pm – 10:00pm. Special entertainment performance by Grammy nominated guitarist/lutenist Richard Savino.  Mr. Savino has been a featured performer throughout the U.S. and abroad.  He is conductor of the group El Mundo, a musical ensemble he founded in 1999.  The group performs music written by Spanish, Italian and Latin American composers from the 17th – 19th centuries.  Awards presented that evening will include the SSVMS Alliance Helping Hands Award, SSVMS Golden Stethoscope Award, Medical Honor Award, and Medical Community Service award. Look for your invitation in the mail.
