Demetrios Simopoulos, MD has stepped down as President-Elect of SSVMS due to the time that would be needed away from his practice to serve as President.  We are pleased that he will remain an active member of the Medical Society.  This has created a vacancy in the office of President-Elect for the remainder of 2012 and President in 2013.  The Board of Directors feels that this position should be filled by someone with recent Executive Committee experience so that continuity of governance can be maintained.  As such, SSVMS’ current President, David Herbert, MD, has been nominated to this position.  Dr. Herbert’s nomination has been seconded by the required number of active members, and he has accepted the nomination.  Article XII, Section 2, paragraph (b) of the SSVMS Bylaws permits additional nominations in writing using a form provided by the Secretary.  A nomination form may be obtained by contacting the Medical Society at (916) 452-2671 and must be completed and returned to the Society by 4:30 pm on December 14 to be considered.

Featuring entertainment by Grammy nominated Guitarist/Lutenist Richard Savino.  Mr. Savino has been a featured performer throughout the U.S. and abroad.  He is the recipient of a Diapason d’Or (a French Grammy), received a Grammy nomination in 2010 and another nomination in 2011 for Best Small Ensemble Recording: The Kingdome of Castile.  He is the director of El Mundo, a chamber group dedicated to the performance of 16th-19th century Latin American, Spanish and Italian chamber music.  Mr. Savino recently completed a cross country tour with opera singer Joyce DiDonato and the Il Complesso Barocco orchestra that concluded with a sold-out concert at Carnegie Hall.

SSVMS Members Elected to Congress and State Assembly.  Congratulations to SSVMS members Ami Bera, MD and Richard Pan, MD, for their successful campaigns for Congress and State Assembly, respectively.

CMS Posts Medicare Fee Schedule Changes.  The Centers for Medicare & Medicaid Services (CMS) recently released addenda to the 2013 Medicare physician fee schedule.  The addenda, which includes modifications to payment policies and quality reporting programs such as e-prescribing and PQRS, can be found in the download section of the CMS website.

ACA Regulations Released.  On November 20, the Obama administration released a number of proposed regulations implementing aspects of the Patient Protection and Affordable Care Act (ACA), including the following:

  • A proposed rule that, beginning in 2014, prohibits health insurance companies from denying coverage to adults based on pre-existing conditions or from charging higher premiums to certain enrollees based on their current or past health problems, gender, occupation, and small employer size or industry. 
  • A proposed rule outlining policies and standards for coverage of essential health benefits, which are a core set of benefits for consumers purchasing health insurance in the Exchanges opening in 2014.
  • A proposed rule implementing and expanding employment-based wellness programs.

Medicare SGR Payment Cut Looms as January 1 Deadline Approaches – Call to Action.  Congress has three weeks left to stop the 26.5% percent Medicare sustainable growth rate (SGR) physician payment cuts (to take effect on January 1, 2013) before they adjourn for the holidays.  In addition to the SGR cut, physicians are facing a potential two percent "sequestration" cut.  The sequestration cuts are part of the $1.2 trillion in cuts required by the budget deal worked out to end last year's debt-ceiling crisis.  SSVMS urges physicians to keep the pressure on Congress to stop these cuts.  Please call your members of Congress and ask them to make health care a priority.  Tell them to stop the Medicare SGR payment cut and allow time for a more stable payment system to be developed.  Let them know the effect these cuts will have on your patients and your practice! Medi-Cal Requiring Physicians to Re-Enroll in January.  The California Department of Health Care Services (DHCS) will soon be notifying physicians that they must re-enroll in Medi-Cal as one of the provisions of the Affordable Care Act (ACA).  The ACA requires every state Medicaid program (Medi-Cal in California) to revalidate provider enrollment information at least every five years beginning January 2, 2013.  Physicians receiving a notice must complete and return the requested form(s) and required attachments within 35 working days of the date of the notice.  Failure to do so may result in payment delays.  Physicians who have revalidated, updated or submitted new applications to the Medicare program within the last 12 months (January 1 through December 31, 2012) will not be required to revalidate at this time.  However, your Medicare enrollment information must match the information on file with the Medi-Cal program.  If it does not, you will receive notice from DHCS requiring you to revalidate.  Click here for more information.

Healthy Families Enrollees Begin Transition to Medi-Cal.  The Department of Health Care Services (DHCS) will soon begin transitioning over 860,000 low-income children from the Healthy Families program to Medi-Cal. Sacramento and Yolo counties are part of Phase 1, Part B and will begin the transfer on or around April 1, 2013.  Click here for more information.

CMS Announces New Exemption Categories for 2013 e-Prescribing Penalty.  In the newly released 2013 Medicare physician payment rule, the Centers for Medicare and Medicaid Services (CMS) approved two additional hardship exemptions that can be used by physicians to avoid e-prescribing reimbursement penalties.  The two new exemption categories include physicians who demonstrated "meaningful use" of an EHR system during the previous e-prescribing period, which ran from January 1, 2011 to June 30, 2012; or those who register to participate in the Medicare or Medicaid EHR incentive programs by January 31, 2013.  The two new exemptions are automatic and physicians do not need to apply for a hardship exemption if they meet one of the two new criteria.  CMS will automatically exempt these physicians from the 2013 payment penalty.  Click here for more information.

DHCS Ready for 5010 Upgrade.  The California Department of Health Care Services (DHCS) recently announced that effective January 1, 2013; Medi-Cal claims must be submitted in the new HIPAA-compliant 5010 format.  After December 31, 2012, all transactions submitted in legacy formats (4010/4010A1, NCPDP 5.1, or 1.1 batch transactions) will be rejected.  DHCS will assist with compliance testing.  Please contact the Computer Media Claims (CMC) Help Desk at (800) 541-5555 (option 4, then option 2).  Practices who have not yet converted can contact CMC directly regarding testing.  Additional information can be located on the Medi-Cal website by clicking here.

What Physicians Need To Know About Anthem Blue Cross’s Contract Amendment.  Anthem Blue Cross recently notified select physicians that it is amending the physician’s Blue Cross Prudent Buyer Agreement to automatically include the new individual/exchange network, effective January 1, 2014.  The new fee schedule associated with this product was included with the notice.  Physicians who do not wish to participate in this network must notify Blue Cross of their intent to opt out by December 31, 2012.  Click here for more information, including resources for physicians contracting with exchange plans.

CMA Publishes Summary of New Health Care Laws.  The California Legislature had an active year passing many new laws affecting health care.  CMA has posted a summary of some of the most important new laws in the “news” section of the CMA website.
